1. Acceptance of Terms
By accessing or using the X10focus app (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
X10focus is a Pomodoro Timer application designed to increase productivity and efficiency for IT engineers and managers. The Service includes features such as smart productivity techniques, focus enhancement tools, integration with Google Calendar and Google Tasks, meeting reminders, task management features, and distractibility reduction mechanisms.
3. User Accounts and Authentication
3.1. To use the Service, you must have a Google or Apple account and authenticate using their respective sign-in services.
3.2. By using the Service, you authorize X10focus to request access to your account for authentication and accessing necessary data.
3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.4. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
4. Data Collection, Storage, and Responsibilities
4.1. Data Collected
When you sign in using Google or Apple, we collect the following data:
- User ID: A unique identifier provided by Google or Apple to distinguish your account.
- Email Address: The primary email associated with your Google or Apple account.
- First and Last Name: Your name as provided by Google or Apple.
- Tasks and Calendar Data: If you grant permissions, we access and store your tasks and calendar data to sync across your devices.
4.2. Use of Collected Data
The collected data is used solely for the purpose of providing and improving the Service, including:
- User authentication and account management.
- Synchronization of tasks and calendar events across devices.
- Personalizing the user experience.
- Customer support and troubleshooting.
4.3. Data Storage
- Google Sign-In Users: X10focus does not store your Google account credentials. Your data remains stored on Google’s servers according to their retention policies.
- Apple Sign-In Users: Tasks and calendar data are stored on our servers to enable synchronization across devices. We take reasonable precautions to protect your data.
4.4. Data Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure.
4.5. Limitation of Liability
The Service is provided on an “AS IS” basis. While we take measures to ensure data integrity, we do not guarantee that stored or processed data will always be available, secure, or free from corruption.
X10focus is not responsible for any loss, corruption, or deletion of data due to system failures, unauthorized access, or other unforeseen circumstances. You acknowledge that it is your responsibility to maintain appropriate backups of your data.
5. Limitation of Liability
5.1. No Warranty on Service Availability: We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free. We may suspend or discontinue the Service at any time without prior notice.
5.2. Limitation on Indirect or Consequential Damages: X10focus shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, profits, or business opportunities, even if we have been advised of the possibility of such damages.
5.3. User Responsibility for Account Security: You are solely responsible for maintaining the confidentiality of your authentication credentials and for all activities that occur under your account. We are not liable for any unauthorized access due to your failure to protect your account.
5.4. No Liability for Third-Party Services: The Service integrates with third-party platforms such as Google and Apple. We are not responsible for the availability, accuracy, or security of data stored on or accessed from third-party services.
5.5. Force Majeure Clause: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, strikes, power failures, internet service disruptions, or cyberattacks.
5.6. Maximum Liability Cap: To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the Service in the past six (6) months, or $10, whichever is greater.
6. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
