1. Acceptance of Terms

By accessing or using the X10focus app (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

X10focus is a Pomodoro Timer application designed to increase productivity and efficiency for IT engineers and managers. The Service includes features such as smart productivity techniques, focus enhancement tools, integration with Google Calendar and Google Tasks, meeting reminders, task management features, and distractibility reduction mechanisms.

3. User Accounts and Authentication

3.1. To use the Service, you must have a Google account and authenticate using OAuth 2.0.

3.2. By using the Service, you authorize X10focus to request access to your Google account using OAuth 2.0 for the purposes of authentication and accessing necessary data.

3.3. You are responsible for maintaining the confidentiality of your Google account credentials and for all activities that occur under your account.

3.4. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

4. Google Services Integration and Permissions

4.1. The Service integrates with Google Calendar and Google Tasks. By using these features, you explicitly grant X10focus permission to:

a) Access your Google Calendar data, including reading, writing, and modifying events. b) Access your Google Tasks data, including reading, creating, updating, and deleting tasks.

4.2. X10focus will request only the minimum necessary permissions required to provide the Service.

4.3. You have the right to revoke these permissions at any time through your Google account settings. However, doing so may limit or prevent your use of certain features of the Service.

4.4. You are responsible for complying with Google’s terms of service in relation to your use of Google services through our Service.

4.5. X10focus does not store your Google account password. Authentication is handled securely through Google’s OAuth 2.0 protocol.

5. Privacy and Data Protection

5.1. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

5.2. You consent to the collection, processing, and storage of your personal data as described in our Privacy Policy.

5.3. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk of processing your personal data.

6. Intellectual Property

6.1. The Service and its original content, features, and functionality are owned by X10focus and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2. You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as incidental to normal web browsing or as expressly authorized by us.

7. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

7.1. In any way that violates any applicable federal, state, local, or international law or regulation.

7.2. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.

7.3. To impersonate or attempt to impersonate X10focus, a X10focus employee, another user, or any other person or entity.

7.4. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm X10focus or users of the Service or expose them to liability.

8. Termination

8.1. We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8.2. Upon termination, your right to use the Service will immediately cease.

8.3. You may terminate your use of the Service at any time by revoking X10focus’s access to your Google account and uninstalling the application.

9. Limitation of Liability

In no event shall X10focus, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of United Arab Emirates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
